Certainly. One crucial step is marshalling the estate assets. This involves identifying and inventorying all the assets belonging to the deceased person. Consequently, we create a detailed list that includes everything from bank accounts and real estate to personal belongings and investments.
Ordinarily, this process involves gathering documentation such as account statements, deeds, and titles. We then prepare a formal Inventory and Appraisal (Forms DE-160/161) to be filed with the court. This document provides a comprehensive overview of the estate’s assets and their estimated values.
I remember one case where we were working with a family who had lost their father unexpectedly. He was a meticulous record-keeper, which made the marshalling process relatively straightforward. Conversely, we’ve also encountered situations where families lacked clear documentation, making it more challenging to identify and value all assets. In those cases, professional appraisals and forensic accounting may be necessary.
According to the American Bar Association, approximately 60% of estates require probate. This highlights the importance of having a well-organized system for tracking assets. Not doing so can lead to delays, disputes, and unnecessary expenses during the probate process.
