Understanding Probate
Steve, for our viewers who may not be familiar, can you briefly explain what probate is and why it’s sometimes necessary?
Probate is a legal process that occurs after someone passes away. It involves validating the will (if there is one), identifying and inventorying the deceased person’s assets, paying off debts and taxes, and ultimately distributing the remaining assets to the beneficiaries.
The Importance of Filing a Petition
You mentioned that probate is sometimes necessary. Can you elaborate on when filing a petition for probate is crucial?
Ordinarily, probate is required if the value of the estate exceeds $184,500. This threshold ensures that assets are properly managed and distributed according to the deceased person’s wishes or state law.
- The process begins with filing a Petition for Probate (Form DE-111) in the Superior Court of the county where the deceased resided.
- This petition formally requests the court to appoint an executor or administrator to handle the estate.
- If there’s a valid will, it must be submitted to the court as well.
Consequently, failing to file for probate when necessary can lead to complications and potential legal disputes among heirs.
I recall a case where a family argued over who should inherit a valuable piece of real estate because no petition for probate was filed. It took months to resolve the issue and cost them a significant amount in legal fees.
