Steve Bliss: Absolutely. I believe selecting an executor or trustee is paramount. This individual will be responsible for managing your estate, paying debts and taxes, and distributing assets according to your instructions. Consequently, choosing someone trustworthy, capable, and familiar with your financial affairs is essential.

Moreover, consider factors like their age, health, and organizational skills. It’s also important to have open conversations with potential executors or trustees about the responsibilities involved. I remember a case where a client named her brother as executor, unaware of his struggles managing his own finances. This ultimately led to complications and disagreements within the family.

Notwithstanding these challenges, selecting an executor doesn’t have to be overwhelming. Many people choose their spouse, adult child, or close friend. You can also consider appointing a professional trustee if you prefer.

Brenda Sanchez: Have there ever been any issues with choosing executors in your experience?

Steve Bliss: I’ve seen instances where the chosen executor was unprepared for the task or had conflicting interests. In one case, an executor who was also a beneficiary ended up prioritizing their own inheritance over fulfilling their duties to other heirs. It created a lot of tension and legal complications.

This underscores the importance of carefully considering all potential candidates and having frank discussions about expectations and responsibilities. Studies by the American Bar Association show that roughly 30% of estates experience some form of conflict or dispute during probate, often stemming from unclear executor appointments.

Brenda Sanchez: What advice would you give to someone starting the estate planning process?

Steve Bliss: My biggest recommendation is to start sooner rather than later. Don’t wait until you’re older or facing a health crisis. Estate planning is for everyone, regardless of age or wealth. A well-crafted plan brings peace of mind knowing your loved ones will be taken care of according to your wishes.
