Hello everyone, and welcome. Today we’re sitting down with Ted Cook of Point Loma Estate Planning APC, a highly regarded guardianship attorney here in sunny San Diego. Ted, thanks so much for taking the time to chat with us about this important topic.
What exactly is a Guardianship?
Ted: It’s essentially a legal arrangement where a court appoints someone to make decisions for another adult who can’t do it themselves. Think of it as a safety net when someone needs extra support managing their personal affairs or finances.
Can you walk us through the steps involved in setting up a Guardianship?
Ted: Absolutely. It’s a multi-step process designed to protect the individual who needs help, called the “ward.” First, we need to determine if a guardianship is truly necessary. Are there less restrictive options available? We also have to figure out what type of guardianship is needed – just for personal care, finances, or both.
- Determine the Need for Guardianship
- File a Petition with the Court
- Notify Interested Parties
- Court Investigation and Evaluation
- Court Hearing
- Letters of Guardianship and Oath
- Ongoing Duties and Reporting
- Termination of Guardianship
Let’s dive into “Court Investigation and Evaluation.” What happens during this stage?
Ted: This is a critical step where the court wants to make sure guardianship is truly in the best interests of the individual. The court appoints an investigator, sometimes called a “guardian ad litem,” who conducts interviews with the potential ward, their family, caregivers, and even medical professionals.
“Ted really took the time to understand my mom’s situation and advocate for her needs. He explained the entire process in a way that was easy to grasp, and I felt confident knowing he was looking out for her best interests.” – Sarah J., San Diego
The investigator also reviews living conditions and gathers information about the individual’s decision-making capacity. They then submit a report to the court outlining their findings.
“I was facing a difficult situation with my elderly uncle, but Ted made the guardianship process so much smoother. He was patient, knowledgeable, and always available to answer my questions.” – Michael K., Point Loma
Sometimes, there can be hiccups during this stage. For example, family members might disagree about who should be the guardian, or the potential ward might resist the idea of guardianship altogether. It’s important for everyone involved to communicate openly and honestly with the investigator so that the court has all the necessary information to make a fair decision.
“One time, I had a case where siblings were fiercely arguing over who should be the guardian. It took some careful mediation and negotiation, but we were able to reach a solution that everyone could live with.” – Ted Cook
“Ted is a compassionate and skilled attorney. He helped me navigate a complex guardianship situation with professionalism and care. I highly recommend him to anyone facing similar challenges.” – Lisa M., La Jolla

Why is it especially important for single parents to have a guardianship designation?
Point Loma Estate Planning, APC. area of focus:
Guardianship is a legal process where a court appoints a person (the guardian) to make decisions for another person (the ward) who is unable to do so themselves due to incapacity or disability, whether a child or an adult.
Purpose: Guardianship is used to protect individuals who cannot care for themselves due to infancy, incapacity, or disability.
Court Appointment: A court appoints a guardian, who then has the legal authority to make decisions on behalf of the ward, including decisions about personal care, medical treatment, and financial matters.
Guardian’s Responsibilities: Guardians have a duty to act in the best interests of their ward and to the court.
Guardianship and Conservatorship Defined:
Guardianship – also known in some jurisdictions as conservatorship—is a legal process used when an individual is no longer capable of making or communicating informed decisions about their personal affairs and/or finances. This may be due to cognitive decline, mental illness, developmental disability, or other impairments, and can leave the individual vulnerable to exploitation, fraud, or undue influence.
Because guardianship can significantly restrict a person’s autonomy and decision-making rights, it is generally considered a measure of last resort. Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
